The trademark registration must be accompanied by a notarized power of attorney that has been authenticated by a Saudi Arabian consulate. Saudi Arabia prohibits the use of multi-class applications. Therefore, a distinct request is necessary for each category of products or services. Arabic is the official vernacular of the proceedings before the Saudi Patent Office. 1. A comprehensive power of attorney in the applicant's name and address, duly notarized, and legalized up to the Saudi Consulate. 2. A copy of the applicant(s) passport. 3. List of products and services included in the trademark. 4. A copy of the trade license. 5. A high-quality representation of the trademark in JEPG format. 6. Two certified documents of the Articles of Association that have been legally validated by the Saudi Consulate.Trademark Application Process
- Trademark Search/Registration Order Form: The CIG Saudi Arabia consultant will verify the information regarding the goods and registration details, follow it up with preliminary advice, and classify the client's goods and services. The order form must be submitted through the Saudi Intellectual Property Authority's website.
- Fee payment: The CIG Saudi Arabia consultant will conduct the pre-filing search and provide the client with a search report upon the payment of the pre-filing search fees. The trademark records of the Ministry of Commerce and Industry will be searched by the General Administration of Trademarksfor similar trademarks. In addition, they will determine whether the trademark meets the registration requirements.
The ministry will make a judgment from one of the following two options after conducting a thorough investigation:
- Acceptance or rejection: subject to the amendment condition (90-day waiver period in the event of acceptance, or 10-day waiver period in the event of refusal).
- Final refusal: If the modification fails to satisfy the necessary criteria or is not made within the designated time frame (10 days).
- The Ministry of Commerce and Industry will disseminate the trademark registration acceptance on the official website upon its completion.
- The registration certificate will be issued by the General Administration of Trademarks of the Ministry of Commerce and Industry if no objection is received from a third party. The certificate will be reviewed and sent to you by our consultant.
