Trademark Registration in Saudi Arabia | CIG Saudi Arabia

Saudi Arabia's economy is among the most robust in the globe. It has recently emerged as a preferred destination for investors from all over the globe. In addition to Saudi legislation, trademark registration and corporate rights protection are guaranteed by the government's backing and the Kingdom's commitment to fostering investment. It is a part of both the World Intellectual Property Organization (WIPO) and the Paris Convention for the Protection of Industrial Property. This makes it easier for businesses to start up in Saudi Arabia and pushes investors to register their brands.

What is a Trademark?

A trademark is an original design that helps people tell the difference between a business's goods and services and those of other businesses. In addition, a trademark can be a name, word, light, shape, picture, or stamp. It can also be software, an app, a website, or a combination of all of these. The Saudi Authority for Intellectual Property (SAIP) offers a range of services linked to trademarks, such as registration, renewal, modification, transfer of ownership, application for or cancellation of license, mortgage, and appeal.

Trademark Classification System in KSA

According to the International Classification of Goods and Services, trademarks in Saudi Arabia are put into 45 different groups. Each class has a list of goods and activities that fall under it. To protect the company's rights, it's important to pick the right title class for the brand. Requirements for Trademark Registration in Saudi Arabia

Along with the trademark application, you must include a power of attorney that has been signed and verified by a Saudi Arabian consulate. Saudi Arabia does not allow applications for more than one class. That means that each type of goods or services needs its own request. Arabic is the language that is used in all hearings before the Saudi Patent Office. 1. A full power of attorney in the applicant's name and address that has been properly notarized and made official up to the Saudi Consulate. 2. A copy of the applicant's passport. 3. A list of the goods and services that feature in the brand. 4. A copy of your business license. 5. An image of the brand that looks good in JEPG format. 6. Two copies of the Articles of Association that have been properly authorized and sent to the Saudi Consulate.

Trademark Application Process

The ministry will make a judgment from one of the following two options after conducting a thorough investigation:
  3. Acceptance or refusal: subject to the amendment condition (90-day waiver period in the event of acceptance, or 10-day waiver period in the event of refusal).Final refusal: If the requested adjustment is not made within the designated time frame (10 days),        Alternatively, if the modification fails to satisfy the necessary criteria:
  1. The Ministry of Commerce and Industry will disseminate the trademark registration approval on the official website upon its completion.
  2. If no objections are raised, the General Administration of Trademarks of the Ministry of Commerce and Industry will issue the registration certificate. The certificate will be reviewed by a member of our team and subsequently transmitted to you.
